在我們廠里，獲得的品牌授權(quán)書不計其數(shù)，為什么有這么多授權(quán)書呢？

也是源于一次意外，也怪我們自己，法律意識太淺薄，太無知。

近30年以來，有100多個品牌是授權(quán)我們鑫峰展柜廠進行展柜/道具制作的，注意，是授權(quán)哦，沒授權(quán)的品牌是不做的。

5年前，有次我們出口瑞士的手表陳列道具，我們告知報關(guān)行是一個品牌的產(chǎn)品，那報關(guān)行為了規(guī)避風(fēng)險，就告訴我們不接受這批貨物。

我還在想，還有這么奇怪的人嗎，有貨還不發(fā)了？后來我又找了2家貨代公司，人家也告訴我是同樣的結(jié)果。也有一家是報關(guān)行不介意，接受了這批貨物，后面發(fā)生的事情才讓我真正的頭大。

海關(guān)發(fā)生了查驗，歐洲的海關(guān)發(fā)現(xiàn)這是一票品牌的貨物，通過輾轉(zhuǎn)聯(lián)系到在東莞工廠的我，問我這票貨是誰讓我做的，有沒有品牌出具的有效授權(quán)書，我一接到海關(guān)的電話，當(dāng)時都有點懵，我是正心正念做生意的人，但是海關(guān)也是例行公事，我一時之間也拿不出授權(quán)書，應(yīng)該說當(dāng)時還沒這概念。

海關(guān)又接連聯(lián)系了瑞士品牌方所有人，問他們，這票貨涉不涉及侵權(quán)，還好我是老實人啊，品牌貨物所有人回復(fù)不是侵權(quán)貨物，從發(fā)生事情到解決完畢20幾天吧，海關(guān)終于給我們放行了，這一票貨物就順利地出去了。

想當(dāng)時如果品牌所有人給海關(guān)的回復(fù)，說我這一票貨是侵權(quán)貨物，那扣貨肯定是一定的了，但絕對不僅僅是扣貨這么簡單，一旦確認為侵權(quán)貨物，那我們的工廠名字一定是上黑名單的！后果沒法估量，掙著白菜錢，就遭大冤枉了。

自從發(fā)生這次事件之后，品牌方就給我們出具了授權(quán)證明書，證明我們是合法生產(chǎn)，因為他們品牌在全球范圍內(nèi)都是一個知名品牌，每次給到報關(guān)行也給這份證明書，就能輕松過關(guān)。

以致于后來接觸的所有的新客戶，但凡涉及到品牌，都要他們出具授權(quán)證明才可以安排生產(chǎn)，不能讓任何一個危險因子潛伏在我們的合作過程當(dāng)中。

之前做的國內(nèi)客戶，拍個照片來，就讓我們生產(chǎn)，現(xiàn)在這樣不行了，一旦涉及到logo，必須要授權(quán)，切莫因小失大。

Our factory has received numerous brand authorization certificates over the years, stemming from an incident that occurred due to our insufficient legal awareness at the time.

In nearly thirty years, over a hundred brands have authorized our Xin Feng Exhibition Cabinet Factory for the production of exhibition cabinets and display fixtures. Please note that we only produce for brands that provide us with authorization.

Five years ago, when exporting watch display props to Switzerland, we informed the customs broker that the shipment was associated with a specific brand. To avoid risk, the customs broker refused the shipment. Initially confused by this—how could someone refuse a shipment when there was cargo to be shipped?—I then approached two other freight forwarding companies, who gave the same response. One broker did not object and accepted the shipment, but what followed became quite problematic.

The shipment was inspected by customs, and European customs identified it as containing branded goods. They eventually contacted me at our factory in Dongguan, asking about the shipment and requesting proof of authorization from the brand. When I received the call from customs, I was taken aback, as I had never faced such a situation and was unaware of the proper procedures at the time.

Customs also reached out to the owner of the Swiss brand to confirm whether the shipment constituted an infringement. Fortunately, as I conduct business honestly, the brand owner responded that the shipment was not an infringement. It took about twenty days to resolve the issue, after which customs cleared the shipment for export.

Had the brand owner confirmed the shipment as infringing, it would have certainly been seized, but the consequences would have been far more severe. Our factory’s name would likely have been placed on a blacklist, and the repercussions would have been immeasurable. We would have suffered significant losses for a relatively minor profit.

Following this incident, the brand provided us with an authorization certificate proving that we were legally producing their goods. Because their brand is internationally renowned, presenting this certificate to customs brokers has facilitated smooth clearance ever since.

This experience led us to establish a policy where, for any new client engagement involving a brand, we now require an authorization certificate before proceeding with production, ensuring no potential risk remains unaddressed during our collaborations.

Previously, for domestic clients, we would produce items based on photos alone. This practice is no longer acceptable, especially when logos are involved. Authorization is mandatory to prevent losing everything over a small oversight.
